2. Not a substitute for the Instructions for Use
This website summarizes and describes the StairAssist Walker for a general audience. It does not replace the product’s Instructions for Use (IFU). Do not use the StairAssist Walker without first reading and understanding the IFU provided with the device. The StairAssist Walker must be used only as described in the IFU. Stair use requires a certified caregiver, a gait belt, and one handrail, and the caregiver must complete the SAW Certified Caregiver Program before use. The device is not intended for independent use by the patient on stairs.
3. Intended use
The StairAssist Walker is intended to provide moderate weight support while walking, ascending, and descending stairs with the help of a SAW Certified Caregiver. It is indicated for use by people with compromised functional mobility who meet the criteria set out in the Instructions for Use. Use outside that intended use, or by anyone who does not meet those criteria, may result in injury.
4. Assumption of risk
You acknowledge and agree that you use StairAssist Walker at your own risk. You understand that there are known and unforeseeable risks associated with StairAssist Walker use, including but not limited to physical discomfort and falling. The provider makes no guarantees and is not responsible for any harm, loss, or damage you may suffer as a result of your use.
5. No guarantee of results
StairAssist Walker, Inc. does not guarantee any specific outcome, medical result, or level of mobility from use of the StairAssist Walker. Individual results depend on many factors outside the company’s control, including the user’s medical condition, the caregiver’s technique, and adherence to the Instructions for Use.
6. Limitation of liability
In no event shall StairAssist Walker, Inc. be liable for any special, incidental, indirect, consequential, or exemplary damages, including but not limited to loss of data or profits, arising out of or in connection with the use of our website or use of the StairAssist Walker other than in accordance with its Instructions for Use. Our maximum aggregate liability under this agreement shall be limited to the fees paid by you under this agreement. The limitations above shall apply regardless of whether the liability arises from negligence or any other legal theory.
